Welcome to SevaDham (“we”, “us” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, services and any related platforms (collectively, the “Platform”) made available by SevaDham. By accessing or using our Platform, you agree to be bound by these Terms.
1. Acceptance of Terms
By visiting or using our Platform, you agree to be governed by these Terms and acknowledge that you are responsible for complying with all applicable laws. If you disagree with any of these Terms, please do not use the Platform.
2. Eligibility
You must be at least 18 years of age or have legal capacity to enter into these Terms to use our Platform. If you are using the Platform on behalf of a company or other legal entity, you represent you have authority to bind that entity and “you” and “your” refer to that entity.
3. Changes to Terms
We reserve the right to modify these Terms at any time without prior notice. Updated Terms will be effective upon posting on this page. It is your responsibility to review the Terms periodically. Your continued use of the Platform means you accept the updated Terms.
4. Services Offered
SevaDham offers temple-related services, spiritual offerings and associated products (collectively “Services”). Service details, availability, pricing and description may change at our discretion.
Important Clause for Online Puja / E-Puja Services
Our e-puja services are performed collectively for all registered devotees on the selected date or daily schedule. Due to the number of participants, it may not be possible to individually read or display every devotee’s name, gotra, nakshatra or intention in the recorded video or live stream.
We perform the puja on behalf of all registered devotees with equal devotion and spiritual intention, regardless of whether their name visibly appears in a recording, visuals, or vocal announcement.
The video recording may include limited or recent devotees (for example, the latest 50 names) purely for representation. Spiritual benefit does not depend on video representation of names, but on the sankalpa performed by the priest on behalf of every devotee.
By registering, you acknowledge and agree to this format and understand that puja benefits are based on sankalpa, not individual name display.
5. Your Obligations
In using our Platform you agree that you will:
- Provide true, accurate and complete information when you create an account or place an order;
- Use the Platform only for lawful purposes and not engage in harmful, unlawful or fraudulent activities;
- Not impersonate another person, create multiple accounts for the same person, or use bots/scripts to access our Platform;
- Maintain the confidentiality of your login credentials;
- Notify us promptly if you become aware of any unauthorized access to or use of your account.
6. Intellectual Property Rights
All content, trademarks, logos, graphics, digital downloads and other material displayed on the Platform are our property or the property of our licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, republish, upload, post, transmit or distribute any material from our Platform for commercial purposes without our express written consent.
7. Third-Party Links & Content
Our Platform may contain links to third-party websites or services that are not operated by us. We do not control, endorse or assume responsibility for the content, privacy or practices of any such third-party. Your use of third-party sites is at your own risk.
8. Use of Platform & Limitations
We provide our Platform and Services “as is” and “as available” without any express or implied warranties, including but not limited to accuracy, reliability, or uninterrupted access. We disclaim liability for any damage or loss arising from your use of the Platform to the fullest extent permitted by law.
9. Indemnification
You agree to defend, indemnify and hold harmless SevaDham, its affiliates, officers, employees, agents and licensors from and against any claims, liabilities, losses, damages, costs or expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms or your infringement of any rights of a third party.
10. Limitation of Liability
To the maximum extent permitted by law, SevaDham shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of or in connection with your use of or inability to use the Platform, even if advised of the possibility of such damages. Our total liability to you for all claims arising under these Terms shall not exceed the amount paid by you in respect of the Services in the 30 days preceding the claim.
11. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Howrah, West Bengal.
12. Severability & Waiver
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force. Failure by SevaDham to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
13. Force Majeure
We will not be liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, power failure, internet outages, strikes or governmental actions.
